Compensation
- Student-Athletes may receive compensation for their Name, Image and Likeness and are able to negotiate such compensation with businesses based on a variety of factors
- Student-Athletes may be compensated by boosters given that it is not an impermissible inducement and it does not constitute pay for play
- Student-Athletes may not receive compensation based on their athletic performance or their athletic accomplishments
- Compensation may not be provided to student-athletes by employees of the institution
Prohibited Categories
- Student-Athletes may not enter into an NIL agreement with any of the following industries:
- Tobacco
- Adult Entertainment
- Controlled substances
- Marijuana or Medical Marijuana
- University of Maryland reserves the right to restrict NIL agreements of other similar products or companies that promote similar products as the above
- University of Maryland reserves the right to restrict NIL agreements that go against the values of the institution
NIL Activity Timing
- Student-athletes are permitted to engage in NIL activities during official team activity on or off campus.
- Student-athletes may not use Maryland marks, logos, or IP to complete NIL activities while “On-Call” unless the organization they are engaging with has the rights through MSP and/or the University.

Institutional Conflicts
- Student-Athletes may not enter into an NIL agreement with any company that conflicts with a University of Maryland agreement. It is possible that your proposed agreement will conflict if you are required to do the following on campus:
- Wear products competitive to Under Armour during team activities, media engagements, community service, etc.
- Promote products competitive to Pepsi during team activities, media engagements, community service, etc.
- Promote products competitive to Comcast during team activities, media engagements, community service, etc.
- Promote products competitive to Secu during team activities, media engagements, community service, etc.
Facility Use
- Maryland Athletics Facility use is permissible for NIL activities provided all forms are signed and you have gone through the proper channels:

Trademarks and Logos
- Use of University or Athletic Department registered trademarks and logos is prohibited without the express written consent of Maryland University or Athletics
- This includes wearing any University of Maryland apparel with trademarks and logos
- You may not utilize photos or videos with University Athletic trademarks and Logos for NIL Activities
- Please contact Omari DeBerry if you have questions about utilizing University Marks for NIL purposes
Academics
- Should you choose to miss class or any academic obligations for an NIL activity there could be repercussions at the individual University of Maryland professor's discretion
Representation for Student-Athletes
Agents:
- Student-Athletes may secure representation (agent or lawyer) for the purposes of NIL. Your representation must be for the intent of marketing/promoting your Name, Image and Likeness, and not for the purposes of athletic promotion.
- Student-Athletes may not secure representation (agent or lawyer) for the purposes of directly or indirectly marketing their athletics ability or athletics reputation
Other Considerations
- International student-athletes should not enter into an NIL agreement without consulting outside legal counsel and ISSS
- Grants, federal aid, and other need based aid may be affected by your NIL Activities
Disclosure of Name, Image, Likeness Activities
- Student-athletes must disclose all compensated NIL activities within 30 days of the activity occurring to UMD through Opendorse.
- The required information in the student-athlete’s disclosure includes, but is not limited to the compensating third-party, business category, individuals and businesses connected to the activity, type of compensation, and all verbal or written NIL agreements.
- Failure to disclose NIL activities may jeopardize a student-athlete’s NCAA eligibility for practice and/or competition. The student-athlete may also be subject to the applicable penalties pursuant to state law.
